Commentary: If you decide to "remove" a slanderous post in order to avoid the consequences of your bad decision - Don't turn around and file a similar slanderous complaint with the BBB!  Two wrongs will not make the situation right!  You will be held accountable!

Unfortunately for Mr. Jason Mascoe of 3431 Velvet Creek Dr., in Marietta, GA 30008, he did not get this good advice before he decided to attack Mechanic's Heating & Air Conditioning, LLC, "Mechanic's".

I have been reporting for some time now that Mechanic's does not take slander lightly.  Nor does Mechanic's allow someone to aimlessly and maliciously attack Mechanic's without Mechanic's sticking back.  Mechanic's has always been a Company that will retaliate against anyone or any Company or Organization who engages in slander against Mechanic's, with everything the Law allows.

I would like to thank Mechanic's for bringing Mr. Jason Mascoe's slanderous statements, posts and lies to my attention.

First, Mechanic’s Responds® has been made aware of the following online post made by Mr. Jason Mascoe on Yahoo:

When I called MECHANIC'S Heating & Air Conditioning, I was told that the service call would cost me $29.95 to diagnose the problem with my heating system. When the service technician came to my house, she told me I would have to pay her $29.95 to diagnose EACH of my TWO furnaces! She looked at one of my furnaces for LESS THAN 3 MINUTES, then told me I would have to pay her another $89.95 to troubleshoot!! She took my $29.95, and I still don't know why my furnace isn't heating properly! DO NOT DO BUSINESS WITH MECHANICS HEATING & AIR CONDITIONING. THEY ARE EXPENSIVE, & NOT HONEST ABOUT THEIR PRICING !!

This all started from a service call Mr. Jason Mascoe placed with Mechanic's on Saturday, January 16, 2010.  The events of the job were written down on Mechanic's Invoice Number 84760.

After the Service Call was provided to Mr. Mascoe, he went on to Yahoo and made the above slanderous post.  In this reporter's opinion, he was acting like a spoiled child breaking a neighbor's windows late at night for the fun of it!

Mechanic's then sent Mr. Jason Mascoe a Demand Letter instructing him to remove his illegal post.

Mr. Jason Mascoe did remove the post for now; however, he turned around and filed another slanderous complaint with the Atlanta BBB which has now made things worse for Mr. Jason Mascoe.

The following information was supplied to the Atlanta BBB in relation to Mr. Jason Mascoe's baseless complaint:

These exhibits are attached hereto (via our web link) as part of this response and are incorporated herein as part of this response as if they were laid out in their entirety.  Our relationship with this customer is contractual in nature and is governed by our “Mechanic’s Terms and Conditions of Service Agreement.”  All services were agreed to in writing by this customer as outlined by his signature on line # 1 of our invoice.  By signing line #2, this customer agreed in part, “The work outlined above has been satisfactorily completed.

This customer is your typical “customer from hell”.  To be candid, this customer is not telling the truth.  This customer did not tell us at any time, until we showed up at the job site, that he has two separate heating systems he wanted service calls and diagnostics performed on.

Do you see any mention that this customer had two separate systems he wants worked on? – No!

 

Mr. Mascoe did not tell our technician he had two systems out when she called to verify the Service Call request and review the Service Call fees with Mr. Mascoe.

Only after our technician arrived at Mr. Mascoe’s home did he mention that he had two separate heating systems he wanted diagnoses performed on.

 

As this customer admits in his “complaint” with the BBB, he agreed to have us look at one unit for $29.95 after our terms were re-explained to him.

 

Mr. Jason Mascoe signed our line number one of our invoice number 84760 agreeing to our Mechanic’s Terms and Conditions of Service and listed online at www.MechanicsAir.com.

 

 

Our technician determined Mr. Mascoe’s first heating system was “short cycling” in her diagnosis findings.  Mr. Mascoe chose not to have any further recommended services performed, nor did he agree to have us look at his second system for an additional $29.95.

 

All services Mr. Mascoe paid for ($29.95) were performed in full by our technician.  Mr. Mascoe even agrees with this statement as evident by his signature on line number two of our invoice number 84760.  By signing line #2, this customer agreed in part, “The work outlined above has been satisfactorily completed.

 

 

 

Mr. Mascoe then went on the Internet and made slanderous statements about our firm as he has in this complaint.  Please notice the online complaint is somewhat different than what he has told the BBB:

Once we discovered Mr. Mascoe’s slanderous statements online, we sent him a Demand letter as listed on www.JasonMascoe.com.

 

Mr. Mascoe even sent us a letter stating he would correct his illegal actions.

 

Mr. Mascoe now wishes to slander us via the BBB.  He will now have to pay penalties we warned about as allowed by Law.

 

If you see an oil change special for $29.95, any 2 year old idiot knows that the special is for one car, not all the cars in your driveway!

 

Mr. Mascoe has picked a fight with the wrong Company.  We have now submitted his file to our MechanicsResponds.com News Division.  Mr. Mascoe now has his own web site with MechanicsResponds.com, www.JasonMascoe.com so that the full truth may be known by all in this matter.

 

Additional legal action is pending by Mechanic’s against Mr. Mascoe for his slanderous statements.  We intend on making an example out of Mr. Jason Mascoe and expose light on his illegal behavior.

 

Mr. Jason Mascoe will be our new “poster child” for future wrong doers against our Company.

 

Mr. Jason Mascoe’s complaint is unfounded, and a sick joke at best.

 

Mr. Jason Mascoe is clearly trying to hurt Mechanic’s.  His own words in his letter to us: “Wishing you Karma, Jason Mascoe

 

 

Of course, NO REFUND will be coming Mr. Mascoe’s way, however, we do have something special in mind for him!

 

The BBB is unfair and treats Mechanic’s harshly out of retribution for not paying the BBB its so called “Membership Fees” way back in 2007. 

 

Mechanic's experience with the Metro Atlanta BBB can be summed up as follows: Not Paying BBB "Membership Fees" = A Bad Letter Grade + Tabloid News Exposure + Government Investigations

As we have repeatedly pointed out to your BBB, and your BBB has continued to ignore, that your BBB is printing outright lies against our firm by failing to disclose to the public, in our so called “BBB Reliability Report” that we have responded in detail to your so called Ad Review Issues.  On Wed, Feb 25, 2009 9:45 am, Dottie Callina told us via email, “Because the original ad challenge was opened in 2007 and you did not respond, the complaint will remain as is.” If this is the case, then put this statement in the ad review report: “Mechanic’s has responded to all these issues raised, but we have decided it’s too late.

The BBB reminds me of a scene from the movie “Back to School”:  Mr. Melon's secretary is setting in a professor's class in which the professor (The BBB) absolutely hates Mr. Melon (Mechanic's) (Rodney Dangerfield's Character).  When the professor realizes that Mr. Melon's personal secretary is "typing notes" for Mr. Melon, the professor sits behind her and says to her something to this effect: "Please take this down for Mr. Melon- Mr. Melon, no matter what you do, no matter what you try, no matter what you say, you will never, never, pass my class."

Our so called “BBB Reliability Report” fails to reflect our now 28,000+ happy customers.  The BBB report does not reflect the thousands (yes that right “thousands”) of customers per season we help, via our “Same Day Service” who are desperate to find relief from Atlanta’s oppressive heat and cold, when no other company has appointments available to come out.  The reason we can do this is because we pay people to stand around waiting for calls unlike other services who set appointments in two to three days.  It costs more and some clients can wait three days and pay less.  That is their choice.

It is interesting how the BBB has never once pointed out to us where we have done anything wrong or illegal.  Furthermore, the BBB chooses NOT to see our many satisfied and happy customers, our “company’s experience in the marketplace in dealing with their customers” (the BBB will not put up a link on our “BBB Reliability Report” to our web site http://www.airconditioningatlanta.com/Mechanics_Customer_Compliments.htm in order to give our potential customers a “fair and balanced” look at what our customers have been telling us about our services), but rather the BBB chooses to stay “blind” and slap our firm with an unfounded “unsatisfactory record” (now and “F”).

No one at the BBB seems to be able to make a final decision on the merits of a complaint.

The BBB seems unable or unwilling to either point out to us where we have violated the Law or our contract in relation to a matter, or to have the professionalism and the courage to put a complaint to bed once and for all.

It seems no one at the BBB reads our responses, but rather just pushes a button on the BBB’s new computer system.

The BBB’s “customer complaint process” seems to be nothing more than an exercise in endurance for both sides.

The BBB allows consumers to abuse the BBB’s services.

The BBB has failed to respond to ANY of our response letters requesting assistance to resolve matters with customers.

Our unresolved complaints on the BBB’s website closely resemble our stopped payments, bounced checks or refusal to pay list.

The BBB engages in “Pay to Play”.

We know nothing is going to change between Mechanic’s and the BBB.  We know the BBB’s mind was made up a long time ago when we did not pay the BBB money to join in 2007.  We know the BBB is going to keep tabloid reporters on our case.  We know we are both going to keep "escalating things" as time goes on.  We know we will have to keep contacting reporters of our own and let them know what is going on.  We know we will have to keep compiling evidence on your BBB. 

 

The actions of your Company are unconscionable.  We truly hope you will reconsider the way you and your Company discriminates against our firm.  We hope you will make the right choice and govern yourselves professionally. 

 

We will keep protecting and sticking up for ourselves, as long as it takes.

 

We know that one day, this will all have to be settled in Court.

 

Clearly, Mr. Jason Mascoe has threatened Mechanic's with harm: "Wishing you Karma, Jason Mascoe ".

 

In this reporter's opinion, If Mr. Jason Mascoe calls you for any service help - Hang Up the Phone Fast! (and watch for any posts on-line!)
